Terms of Service

1. Acceptance of Terms

By accessing or using the StruKture website at strukture.build and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and StruKture LLC ("StruKture," "we," "us," or "our").

2. Description of Service

StruKture provides an online platform for residential deck and pergola design, including:

• An interactive 3D deck builder with 2D plan views and photo overlay visualization.
• Downloadable deck plans, blueprints, cut lists, and material breakdowns.
• AI-powered design suggestions and yard analysis.
• Satellite imagery integration for property visualization.
• Material comparison tools and cost estimation.
• Contractor matching and referral services.
• Educational content including build guides, permit guides, and a knowledge base chatbot.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Maintain the security and confidentiality of your password.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account. By creating an account, you represent that you are at least 18 years of age.

4. Plans and Blueprints

4.1 Plan Tiers and Pricing

• Starter Plan ($299): Up to 150 sq ft, rectangular decks.
• Pro Plan ($499): Up to 300 sq ft, includes L-shapes and multi-section layouts.
• Premium Plan ($799): Unlimited area, custom shapes, and priority support.

Material costs are separate and calculated based on your deck configuration.

4.2 Important Disclaimers

StruKture plans are designed as construction planning aids and are NOT stamped engineered drawings. While our plans incorporate structural calculations based on the International Residential Code (IRC 2021) and state-specific amendments, they are generated by software and have not been reviewed or sealed by a licensed professional engineer.

• Most jurisdictions require a licensed engineer's stamp for building permit approval. An engineer review add-on is available through StruKture.
• Local building codes, zoning ordinances, and HOA restrictions vary. It is your responsibility to verify compliance with your local jurisdiction before construction.
• Site-specific conditions (soil type, drainage, slope, utility locations) may require modifications to any plan. Always call 811 before digging.
• StruKture is not responsible for construction errors, code violations, or structural failures resulting from improper construction, modification of plans, or failure to obtain required permits and inspections.

4.3 Structural Calculations

Our software references IRC 2021 Section R507 (Exterior Decks) and state-specific amendments (including Utah Title 15A) for structural sizing recommendations, including joist spans, beam sizing, post spacing, footing depths, and load calculations. These calculations are based on standard assumptions and may not account for all site-specific variables. Always consult a local building professional for final verification.

5. Payments and Refunds

• All payments are processed securely through Stripe. We do not store your payment card information.
• Prices are listed in US dollars and are subject to change with notice.
• Refund Policy: Full refund within 7 days of purchase if your custom plans have not yet been generated. 50% refund within 14 days after plan generation. No refunds after 14 days.
• Materials ordered through StruKture are non-refundable once shipped by the supplier.
• Engineer review add-on fees are non-refundable once review has commenced.

6. Intellectual Property

6.1 StruKture Content

The Service, including its design, code, graphics, 3D models, text, and all other content created by StruKture, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any StruKture content without our written permission.

6.2 Your Designs

You retain ownership of the deck designs and configurations you create using the Service. By using the Service, you grant StruKture a non-exclusive, royalty-free license to use anonymized versions of your designs for the purpose of improving the Service, generating aggregate statistics, and showcasing design examples (without personally identifiable information).

6.3 Purchased Plans

Plans purchased through StruKture are licensed for personal, single-project use only. You may share plans with your contractor or building department for the specific project they were created for. Plans may not be resold, redistributed, or used for multiple projects without purchasing additional licenses.

7. Contractor Network

StruKture connects homeowners with independent contractors through our referral network. Important terms:

• Contractors in the StruKture network are independent businesses, not employees or agents of StruKture.
• StruKture verifies contractor applications (license, insurance, experience) but does not guarantee the quality of work performed.
• Any agreement between you and a contractor is solely between those two parties. StruKture is not a party to such agreements.
• StruKture is not responsible for disputes, damages, delays, or any issues arising from work performed by contractors.
• We encourage you to independently verify contractor credentials, obtain multiple quotes, and check references before hiring.

8. AI-Powered Features

The Service includes AI-powered features (chatbot, yard analysis, design suggestions) powered by third-party AI models. You acknowledge that:

• AI-generated responses and suggestions are for informational purposes only and should not be relied upon as professional engineering, legal, or construction advice.
• AI analysis of yard photos provides estimates only; actual measurements should be verified on-site.
• Photos and text submitted to AI features are processed by OpenAI's API. See our Privacy Policy for details.

9. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems.
• Interfere with or disrupt the Service or servers/networks connected to the Service.
• Use automated means (bots, scrapers) to access the Service without our written consent.
• Misrepresent your identity or impersonate any person or entity.
• Upload malicious code, viruses, or harmful content.
• Use the AI chatbot to attempt to extract information unrelated to deck and pergola construction.
• Resell, redistribute, or commercially exploit the Service or its content without authorization.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRUKTURE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service.
• Any errors, inaccuracies, or omissions in structural calculations, plans, or material estimates.
• Construction defects, property damage, or personal injury resulting from the use of plans generated by the Service.
• Any unauthorized access to or use of our servers or your personal information.
• Any conduct or content of any third party on the Service, including contractors.

IN NO EVENT SHALL STRUKTURE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO STRUKTURE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless StruKture and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of your use of the Service, violation of these Terms, construction activities based on plans obtained through the Service, or violation of any rights of a third party.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah. You consent to personal jurisdiction and venue in such courts.

13. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease.
• Previously purchased and downloaded plans remain yours to use for their intended single-project purpose.
• We may delete your account data after a reasonable retention period, subject to legal requirements.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms on this page and updating the "Effective Date." Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the other provisions will remain in full force and effect.
